Introduction
Welcome to Creator Protocol. These Terms of Service ("Terms") are entered into by and between you ("you" or "your") and Creator Protocol LLC ("Creator Protocol," "we," "our," or "us"). These Terms, together with our Privacy Policy and any documents expressly incorporated by reference (collectively, the "Agreement"), govern your access to and use of creatorprotocol.com and any related subdomains (collectively, the "Website"), including any content, functionality, and services offered on or through the Website (the "Services").
Legal Agreement
Please carefully read these Terms before you access or use any of our Services as they are a binding legal agreement. By accessing or using any part of our Website or Services, purchasing any product or service offered by us, or clicking to accept or agree to the Terms when this option is made available to you, you unconditionally accept and agree to be bound by this Agreement. If you do not want to agree to these Terms or the Agreement, you must not access or use any part of our Website or Services.
THESE TERMS CONTAIN A MANDATORY ARBITRATION PROVISION AND CLASS ACTION WAIVER IN SECTION 14 THAT WAIVE YOUR RIGHT TO A COURT HEARING, RIGHT TO A JURY TRIAL, AND RIGHT TO PARTICIPATE IN A CLASS ACTION UNLESS YOU OPT OUT. ARBITRATION IS MANDATORY AND IS THE EXCLUSIVE REMEDY FOR ANY AND ALL DISPUTES UNLESS OTHERWISE SPECIFIED BELOW.
General Use
You represent and warrant that you have the full right and authority to enter into this Agreement and to perform the acts and obligations required hereunder.
Creator Protocol reserves the right to update and change this Agreement from time to time by posting updates or changes to our Website. It is your responsibility to check this page periodically for changes. By continuing to access or use the Website or Services after such changes, you agree to be bound by the modified Agreement. If the modified Agreement is not acceptable to you, you must discontinue your access and use of our Services.
We reserve the right to limit the access, use, or sale of our Website and Services to any person, geographic region, or jurisdiction at our sole and exclusive discretion.

1. Age Requirement
By accessing or using any part of the Website or Services, you represent and warrant that you are at least eighteen (18) years of age or the age of majority in your jurisdiction, whichever is greater. If you do not meet this requirement, you must not access or use the Website or Services.
2. Intellectual Property Rights
These Terms permit you to use the Website and Services for your personal use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Website unless otherwise stated herein.
All aspects of our Website are protected by U.S. and international copyright, trademark, and other intellectual property laws, including all content, information, design elements, text material, logos, taglines, photographic images, testimonials, icons, video and audio clips, and downloads. No material on the Website may be copied, reproduced, distributed, republished, uploaded, displayed, posted, or transmitted in any way without our express written consent. The Creator Protocol trademark and logo are proprietary marks of Creator Protocol LLC, and the use of those marks is strictly prohibited without written permission.
Subject to your continued strict compliance with this Agreement, Creator Protocol provides to you a revocable, limited, non-exclusive, royalty-free, non-sublicensable, non-transferable license to use the Website and Services. You acknowledge and agree that you do not acquire any ownership rights in any material protected by intellectual property laws.
3. Prohibited Uses
You agree not to use or attempt to use the Website, Services, or any materials provided by Creator Protocol in any unlawful manner or a manner harmful to Creator Protocol. You further agree not to:
(a) Harmful Acts. Engage in any dishonest or unethical practice; violate any law; harm Creator Protocol's reputation; hack or attack the Website; scrape, crawl, or otherwise copy content on the Website without permission; introduce viruses or malicious code; interfere with the security or operation of the Website; infringe another party's intellectual property rights; impersonate Creator Protocol, a Creator Protocol employee, another user, or any other person or entity; or engage in any conduct that restricts or inhibits anyone's use of the Website and Services.
(b) Spamming and Unsolicited Communications. Send or authorize any communications deemed spamming or unsolicited solicitations. It is your obligation to ensure that all communications comply with applicable anti-spam laws.
(c) Offensive Communications. Send, post, or authorize any communication that is sexually explicit, obscene, vulgar, pornographic, offensive, profane, hateful, threatening, harmful, defamatory, libelous, harassing, discriminatory, graphically violent, or solicitous of unlawful behavior.
(d) Sensitive Information. Upload or incorporate into the Website or Services any social security numbers, credit card data, passwords, security credentials, bank account numbers, or other sensitive personal, health, or financial information.
4. Our Privacy Policy and Your Personal Information
We respect your privacy and the use and protection of your personal information. Your submission of personal information through the Website is governed by our Privacy Policy, which is incorporated into this Agreement. Creator Protocol reserves the right to modify its Privacy Policy from time to time.
5. Information You Provide; Registration; Passwords
You may be required to create an account with Creator Protocol for certain Services. You represent and warrant that the information you provide is truthful and accurate. Failure to do so may result in termination or suspension of your account. You are responsible for maintaining the confidentiality of any username and password, and you agree not to transfer your credentials or account access to any third party. You are fully responsible for all activity under your account. If you become aware of any unauthorized use of your account, you must notify us immediately at [email protected].
6. Order Placement; Acceptance; Payment
If you make a purchase from us, payment must be received before your order is accepted. We may require additional information regarding your order if any required information was missing or inaccurate, and may cancel or limit an order any time after it has been placed. You must contact us immediately at [email protected] to modify or cancel a pending order. We cannot guarantee that we will be able to amend your order.
All advertised prices and charges are in U.S. Dollars.
By submitting credit card information or other payment information to us, you represent and warrant that: (i) you are authorized to use that card or account; (ii) all payment information provided is complete and accurate; (iii) you will be responsible for any card or bank fees; and (iv) sufficient funds exist to pay the amount(s) due.
We and our third-party payment service providers may request and receive updated credit card information from your credit card issuer. If such updated information is provided, we will update your account accordingly and use it to process payments. Your credit card issuer may give you the right to opt out of this updating service.
If your bank or credit card issuer reverses a charge, we may bill you directly and seek payment by another method.
7. Our Products and Services
Our Services may have additional terms and conditions specific to each product or service. These terms will be provided to you prior to purchase. In the case of a conflict between those separate terms and these Terms, the separate terms will prevail.
8. Pricing
Creator Protocol reserves the right, without notice, to discontinue products or services or modify specifications and prices without incurring any obligation to you. Any price changes will take effect following email notice to you.
Creator Protocol does not warrant that product or service descriptions are accurate, complete, current, or error-free. All sales are deemed final except as provided otherwise in this Agreement.
9. Your Responsibilities
You are solely and exclusively responsible for complying with all applicable laws and regulations in connection with your use of our Services and any business activities related thereto, including but not limited to all laws governing advertising and marketing claims, tax laws, and all additional applicable laws.
You are solely and exclusively responsible for collecting and reporting all sales and use taxes and any other taxes that may apply to your business. Creator Protocol shall not be responsible for any taxes applicable to your business.
10. Testimonials and Reviews
Creator Protocol welcomes your comments regarding our Services and products. You represent and warrant that any reviews or testimonials you submit are truthful, honest, and reflect your own experience. Creator Protocol may use any posted testimonials and/or product reviews, in whole or in part, together with the name and location of the person submitting it. Testimonials may be used for any form of advertising or promotional material as Creator Protocol determines in its sole discretion.
Testimonials, reviews, photographs, videos, and other information that you provide to us will be treated as non-confidential and nonproprietary. By providing them, you grant Creator Protocol a royalty-free, worldwide, perpetual, nonexclusive, and irrevocable license to use them. Creator Protocol reserves the right to edit testimonials for grammar, length, or clarity prior to use.
Testimonials represent the unique experience of the individuals submitting them and do not necessarily reflect the experience you may have using our Services or products. Student and customer results vary based on effort, experience, and other factors. Many individuals do not apply the strategies taught and thus see little to no financial return. We cannot and do not promise any specific financial result.
11. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold Creator Protocol and its officers, directors, agents, affiliates, licensors, successors, representatives, and employees harmless from and against any and all claims, actions, liabilities, losses, expenses, damages, and costs (collectively, "Losses"), including attorneys' fees, arising out of (1) your breach of any term, warranty, representation, or covenant in this Agreement, or (2) your violation of any applicable law, rule, regulation, or third party's rights.
Creator Protocol will maintain control of the defense and/or settlement of any Losses, at your expense. You agree you will not settle any third-party claim in a manner detrimental to Creator Protocol without written consent.
12. Disclaimers of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE, OUR SERVICES, AND ALL CONTENT ARE PROVIDED ON AN "AS IS," "AS AVAILABLE," AND "WHERE IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. WE MAKE NO REPRESENTATIONS OR WARRANTIES AS TO THE RELIABILITY, TIMELINESS, QUALITY, SUITABILITY, AVAILABILITY, ACCURACY, OR COMPLETENESS OF OUR SERVICES OR ANY INFORMATION ON OUR WEBSITE. WE DO NOT REPRESENT OR WARRANT THAT: (A) THE USE OF THE WEBSITE OR OUR SERVICES WILL BE SECURE, TIMELY, UNINTERRUPTED, OR ERROR-FREE; (B) THE WEBSITE OR SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS; (C) ANY STORED DATA WILL BE ACCURATE OR RELIABLE; (D) ERRORS OR DEFECTS IN THE WEBSITE WILL BE CORRECTED; OR (E) THE WEBSITE OR SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF AND ACCESS TO THE WEBSITE AND SERVICES ARE ENTIRELY AT YOUR OWN RISK.
13. Limitations of Liabilities
IN NO EVENT SHALL CREATOR PROTOCOL OR ANY OF ITS AFFILIATES, OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, INDEPENDENT CONTRACTORS, REPRESENTATIVES, OR AGENTS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, CONSEQUENTIAL, PUNITIVE, OR ANY OTHER DAMAGES, FEES, COSTS, OR CLAIMS ARISING FROM OR RELATED TO THIS AGREEMENT, THE SERVICES OR PRODUCTS, OR YOUR USE OR ATTEMPTED USE OF THE WEBSITE, REGARDLESS OF WHETHER CREATOR PROTOCOL HAD NOTICE OF THE POSSIBILITY OF SUCH DAMAGES. THIS INCLUDES, WITHOUT LIMITATION, ANY LOSS OF USE, LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR COST OF PROCUREMENT OF SUBSTITUTE SERVICES. THIS APPLIES REGARDLESS OF THE MANNER IN WHICH DAMAGES ARE CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER FOR BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY), WARRANTY, OR OTHERWISE.
APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES. IN SUCH CASES, OUR LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
14. Dispute Resolution by Mandatory Binding Arbitration and Class Action Waiver
If you have a complaint, dispute, or controversy, you agree to first contact us at [email protected] to attempt to resolve the dispute informally. You and Creator Protocol agree that any disputes that cannot be resolved informally or through negotiation within 120 days will be resolved through binding and final arbitration instead of court proceedings. You and Creator Protocol hereby waive any right to a jury trial.
All controversies, claims, counterclaims, and other disputes arising between you and Creator Protocol relating to these Terms, the Privacy Policy, this Agreement, any purchase you make, any communications between us, and/or any aspect of our relationship (each a "Claim"), shall be submitted for binding arbitration in accordance with the Rules of the American Arbitration Association, Consumer Arbitration Rules ("AAA Rules").
YOU ACKNOWLEDGE AND AGREE THAT YOU ARE WAIVING THE RIGHT TO A TRIAL BY JURY. YOU AGREE THAT YOU MAY ONLY BRING A CLAIM IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE PROCEEDINGS OR PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.
The AAA's Rules are available at www.adr.org or by calling 1-800-778-7879. The arbitration will be heard by a single arbitrator in the English language in the State of Florida, telephonically, or at a mutually agreed upon location in the United States. The arbitrator's decision will be final and binding and may be enforced in any court of competent jurisdiction.
Payment of all filing, administration, and arbitrator fees will be governed by the AAA's Rules. In all other respects, the parties shall each pay their own fees, costs, and expenses. This arbitration agreement does not preclude either party from seeking action by government agencies or from bringing qualifying claims in small claims court. Both parties retain the right to apply to any court of competent jurisdiction for provisional relief, including preliminary injunctions.
The arbitrator shall follow the Federal Arbitration Act, 9 U.S.C. §§ 1-16, as amended. The substantive law of the State of Florida shall apply without regard to conflicts of laws principles.
Neither party may act as a class representative or participate as a member of a class of claimants. Claims may not be arbitrated on a class or representative basis.
If any provision of this Section is found to be invalid or unenforceable, that provision shall be severed, and the remainder shall continue in full force and effect. If any claim or dispute is found to be excluded from this arbitration agreement, the parties agree it shall be exclusively brought in the state or federal courts located in the State of Florida.
This Section will survive the termination of your relationship with Creator Protocol.
30 DAY RIGHT TO OPT-OUT. YOU HAVE THE RIGHT TO OPT OUT OF THE ARBITRATION AND CLASS ACTION WAIVER PROVISIONS BY SENDING WRITTEN NOTICE OF YOUR DECISION TO OPT OUT BY EMAILING US AT [email protected]. THE NOTICE MUST BE SENT WITHIN THIRTY (30) DAYS OF ACCEPTING THESE TERMS. IF YOU OPT OUT, WE ALSO WILL NOT BE BOUND BY THEM.
15. Third-Party Links
The Website may contain links to other websites. Creator Protocol is not responsible for and does not verify the accuracy of any information contained on third-party websites. Creator Protocol shall not be liable for the content or functionality of any third-party website or for any purchase or participation in an offer between you and a third party. Please see our Privacy Policy for more details.
16. Termination
If, in our sole discretion, you fail or we suspect that you have failed to comply with this Agreement or any applicable law, we may immediately terminate the Agreement or suspend your access to the Website and Services at any time without notice. Upon termination, you remain responsible for any outstanding payments to Creator Protocol.
17. No Waiver
No failure or delay by Creator Protocol in exercising any right, power, or remedy under this Agreement shall operate as a waiver, nor shall any single or partial exercise preclude any other or further exercise of such right. A waiver shall only be effective if in writing and signed by Creator Protocol.
18. Force Majeure
Creator Protocol will not be responsible for any delay, damage, or failure caused by any act of nature or other causes beyond our reasonable control, including but not limited to power outages and governmental restrictions.
19. Assignment
Creator Protocol may assign its rights under this Agreement at any time without notice to you. Your rights under this Agreement cannot be assigned without Creator Protocol's express written consent.
20. Electronic Signature
All information communicated on the Website is considered an electronic communication. You agree that electronic communications from us are equivalent to written communications and shall have the same force and effect as if they were in writing and signed by the sending party.
21. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision may be modified or severed to the extent necessary.
22. Entire Agreement
This Agreement and any documents incorporated by reference constitutes the entire agreement between you and Creator Protocol and governs your access to and use of the Website and Services. It supersedes all prior or contemporaneous agreements, representations, and proposals, whether oral or written. Any new features or services offered through the Website shall also be subject to this Agreement.
23. Gaurantee
We gaurantee to work with you until you make your money back from the financial investment in our program. To qualify for this gaurantee you must put effort into making this work.
- Get through 90% of the course.
- Attend half of the coaching calls each week on average.
- Must post an avarage of 7 times per week through the duration of your program.
If there has been no course or call activity in 60 days then access will be removed if its past your purchased period.
24. SMS Communications
Creator Protocol LLC provides educational coaching and training services for content creators. By providing your phone number and opting in to receive SMS messages, you consent to receive text messages from Creator Protocol LLC including but not limited to: appointment reminders, enrollment confirmations, program updates, promotional offers, coaching session notifications, and account alerts.
You can cancel the SMS service at any time. Just text "STOP" to +1 727-334-0511. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at [email protected].
Carriers are not liable for delayed or undelivered messages.
As always, message and data rates may apply for any messages sent to you from us and to us from you. During active enrollment periods you may receive up to 4–6 messages per week. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
Consent to receive SMS messages is not a condition of purchase or enrollment in any Creator Protocol LLC program or service.
